Bonita Springs Uber Accident Lawyer

The rideshare program Uber has only been in operation in Bonita Springs since 2014. Since then, though, the program has become more popular every year. Tourists and residents alike use Uber due to the fact that it is affordable and very convenient. Unfortunately, drivers for Uber can become involved in an accident just like any other driver on the road. Also just like other crashes, accident victims may be able to claim compensation after a crash. Unlike other accidents, these cases are extremely complicated due to the fact that they involve a ridesharing company. Our Bonita Springs Uber accident lawyer can guide you through the claims process so you obtain the full compensation you deserve.

Filing a Claim as Another Driver

If you were driving at the time of the accident and an Uber driver crashed into you, you have many options for obtaining compensation. First, under the no-fault auto insurance laws in Florida, you must first exhaust your own personal injury protection (PIP) benefits before you can file a claim against another driver. After you have exhausted your own PIP benefits and still have not received enough compensation to cover your injuries, you can file a third party insurance claim.

The third party you try to obtain compensation from will depend on the activity of the Uber driver during the accident. If the Uber driver was not using the app, you must file a claim with the insurance company that covers the driver personally. If the driver was using the Uber app but did not have a passenger, Uber will cover up to $50,000 in bodily injury coverage per person, and as much as $100,000 in bodily injury coverage for the entire accident. Uber also provides a maximum of $25,000 in property damage coverage per accident.

If the driver was logged into the Uber app and had a passenger, or was going to get a passenger, Uber will cover up to $1 million in damages for the accident.

Filing a Claim as an Uber Passenger

While other motorists can certainly become hurt by an Uber driver, the passengers they carry are also at risk of becoming hurt. If you were a passenger during an Uber accident, you can still file a claim for PIP coverage if you have your own no-fault auto insurance. If another driver caused the crash, you will have to file a claim with the negligent motorist’s insurance company. If the Uber driver was at fault and you suffered injury, you can file a claim with Uber and receive up to $1 million in coverage.
